Terms of Service

These Terms of Service ("Terms") govern your use of the website purpleowl.io and the Firebase Client Setup Wizard and related tools (collectively, the "Services") provided by PurpleOwl LLC ("PurpleOwl," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you represent that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

PurpleOwl provides a Firebase Client Setup Wizard that automates the process of provisioning Firebase projects in users' Google Cloud accounts. The wizard uses OAuth to obtain temporary authorization to create projects, configure Firebase services, and deploy applications on your behalf.

Our Services also include open-source tools and templates available through GitHub and other platforms.

3. OAuth Authorization and Access

3.1 Temporary Access Only

When you use the Firebase Client Setup Wizard, you grant us temporary access to your Google Cloud account through Google's OAuth authorization flow. This access is used solely to perform the setup operations you have requested.

Immediately upon completing the setup process, we programmatically revoke our access token. We do not retain ongoing access to your Google account or any projects created through our wizard.

3.2 Your Responsibilities

You are responsible for maintaining the security of your Google account credentials. You acknowledge that the Firebase projects created through our wizard are created in your Google Cloud account and are subject to Google's terms of service and billing policies. You are responsible for managing and securing any projects created through our Services.

3.3 Google Cloud Terms

Your use of Google Cloud Platform and Firebase services is governed by Google's terms of service. We are not responsible for any actions taken by Google or changes to Google's services, pricing, or terms.

4. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services in any way that violates applicable laws or regulations, to attempt to interfere with or disrupt the integrity or performance of our Services, to attempt to gain unauthorized access to our systems or networks, to use our Services to create projects for illegal or fraudulent purposes, or to misrepresent your identity or affiliation when using our Services.

5. Intellectual Property

5.1 Our Content

The Services and their original content (excluding content provided by users or available through open-source licenses), features, and functionality are owned by PurpleOwl and are protected by copyright, trademark, and other intellectual property laws.

5.2 Open Source

Certain tools and templates we provide are released under open-source licenses, such as the MIT License. Your use of such materials is governed by the applicable open-source license terms.

5.3 Your Content

Any content or data you provide or create using our Services remains your property. By using our Services, you grant us a limited license to use such content solely as necessary to provide the Services to you.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PURPLEOWL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free. We do not warrant that any defects will be corrected or that the Services will meet your requirements.

We are not responsible for any issues arising from Google Cloud Platform, Firebase, or any other third-party services.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PURPLEOWL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE SERVICES DURING THE TWELVE MONTHS PRECEDING THE CLAIM. BECAUSE OUR SERVICES ARE PROVIDED FREE OF CHARGE, OUR MAXIMUM LIABILITY SHALL BE ONE HUNDRED DOLLARS ($100).

8. Indemnification

You agree to indemnify, defend, and hold harmless PurpleOwl and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, your violation of any third-party rights, or any content or data you submit through the Services.

9. Third-Party Services

Our Services may contain links to third-party websites or integrate with third-party services, including Google Cloud Platform and Firebase. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are governed by their respective terms and policies.

10. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue the Services at any time without notice. We may also modify these Terms from time to time. We will notify you of material changes by posting updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PurpleOwl regarding the Services and supersede any prior agreements.
